Крипторынок Кыргызстана vs международные биржи и энергодефицит: полный обзор

Кыргызстан занял 76-е место в мировом индексе принятия криптовалют по версии Chainalysis, хотя лидирует в регионе по числу обменников и имеет мягкое госрегулирование. Кыргызстанские бизнесмены рассказали Bits.Media о конкуренции с зарубежными криптобиржами и майнинге, а также своем желании изменить законодательство.

P2p-вызов для криптобизнеса

Жители Кыргызстана чаще выбирают p2p-услуги крупных зарубежных криптобирж. В ответ на это кыргызстанская Ассоциация участников рынка виртуальных активов (АУРВА) лоббирует поправки в законодательство, которые обеспечат привилегии местным операторам цифровых активов и введут запрет на работу нелицензированных иностранных площадок — которые до сих пор не запрещены в стране и свободно обслуживают кыргызстанцев.

«Через p2p-площадки зарубежных бирж удобно обменивать криптовалюту на суммы до $10000. Это быстро и доступно, но, к сожалению, связано с серьезными рисками для граждан КР», — заявил Bits.media соучредитель и гендиректор критповалютного инвестхолдинга Royal Арстанбек Абдикапаров.

Риски, по его мнению, связаны с опасностью оказаться вовлеченными в схемы отмывания денег. Кроме того, иностранные платформы не предлагают возможности конвертации криптовалюты в наличные, как местные обменники.

Соосновательница WeinCrypto DAO Елена Чигибаева считает, что защита местных платформ за счет ограничения деятельности крупных международных игроков не защитит местных операторов и пользователей.

«Опыт Узбекистана показывает, что такие меры не дают желаемого эффекта. Соседний Казахстан пошел другим путем, создав условия для работы как международных, так и местных площадок. Это способствует развитию рынка в целом», — объяснила Елена Чигибаева.

По ее словам, рынок криптовалют в Кыргызстане все еще находиться на стадии формирования, но показывает стабильный рост по экономическим показателям.

Главные экономические показатели

Летом 2024 года объем операций с криптовалютами в Кыргызстане достиг 26.1 млрд сомов ($300 млн), увеличившись на 166% по сравнению с 9.8 млрд сомов ($113 млн) в июле 2023 года. К августу в стране насчитывалось 118 обменников, восемь криптобирж и восемь майнинговых компаний.

Общий оборот площадок виртуальных активов за январь — июль достиг 375.9 млрд сомов ($4.3 млрд), а компании заплатили 92.2 млн сомов ($1.1 млн) налогов.

В первой половине 2024 года майнеры Кыргызстана потребили 118 462 кВт·ч электроэнергии, что существенно ниже показателя 2023 года в 213 283 кВт·ч. За позапрошлый год майнинговые компании уплатили налогов на электричество на сумму 93.7 млн сомов ($1.1 млн), тогда как за первые семь месяцев прошлого года налоговые отчисления составили 30.7 млн сомов ($353.7 тыс.).

По мнению экспертов Минфина, дефицит и ужесточение правил использования энергии стали факторами, негативно влияющими на добычу криптовалют в Кыргызстане. По словам соосновательницы и генерального директора WeinCrypto DAO Елены Чигибаевой «многие майнеры после халвинга биткоина либо прекратили добычу криптовалют, либо переживают трудные времена».

Обменники Кыргызстана

Отличительной чертой криптоиндустрии Кыргызстана от Беларуси и Казахстана является ориентированность рынка на обменные операции.

Из-за международных санкций криптовалюты стали важным инструментом для денежных переводов между Россией и Кыргызстаном — и для трудовых мигрантов, и для внешнеэкономических операций. По данным 2024 года, 98% оборота криптовалют в Кыргызстане пришлось на обменные площадки.

Крупные обменники

Головные офисы криптообменников сконцентрированы в столице Кыргызстана Бишкеке.

netex.kg — обменная площадка, которая работает на рынке с 2019 года, конвертирует BTC, BCH, ETH, LTC, рубли, доллары, евро, кыргызские сомы в режиме онлайн с комиссией от 0.5% и офлайн без комиссии (в офисе). Поддерживает платежные системы Perfect Money, Payeer, AdvCash, Qiwi, Yandex. Услугами обменника пользуются 876 025 клиентов, суточный объем торгов — от $250 000. Есть сервисы по созданию и торговле NFT и обслуживанию юрлиц.

Bitok.kg — обслуживает 10 000 пользователей из 170 стран, обменивает удаленно и в офисе BTC, USDT, LTC, ETH, SOL, BCH, рубли, доллары, евро, сомы.

xbt.kg — обменивает BTC, USDT, LTC, ETH, SOL, BCH, DOGE, рубли, доллары, евро, сомы, предусматривает онлайн/оффлайн-обмен, позволяет оплачивать коммунальные услуги в Кыргызстане. Обмен на всех площадках осуществляется только в безналичной форме, использование наличных запрещено.

Криптобиржи Кыргызстана

В 2024 году в Кыргызстане действуют восемь лицензированных операторов торговли виртуальными активами: «Азимут Капитал», «Биатекс», «Биткор», «Бит Руби», «Енвойс Вижионн диджитал эксчейндж» , «Стандарт Девелопмент», «Токенспот» , «Экспрайм».

Объем торгов на криптобиржах Кыргызстана за первое полугодие 2024 года составил 8.2 млрд сомов (более $15.7 млн). Обязательный уставной капитал для операторов криптобирж составляет 200 млн сом (более $2 млн).

Отсутствие ликвидности тормозит развитие криптобирж в Кыргызстане, считает соосновательница WeinCrypto DAO Елена Чигибаева.

«Опытные пользователи отдают предпочтение крупным и надежным платформам, таким как Binance, Bybit которые, хотя они не лицензированы в КР — но и не запрещены. А местных энтузиастов необходимо обучать криптограмотности», — сказала Bits.media Елена Чигибаева.

Соучредитель Royal Арстанбек Абдикапаров считает, что конкуренцию с крупными международными игроками также усложняет отсутствие у местных бирж надежной технологической базы.

Крупные криптобиржи

Envoys Vision — на рынке с 2021 года, офис в Бишкеке. Кроме торгов 50 криптовалютами, включая USDT, BTC, TRX, ETH, предлагает фиат — сомы, российские рубли, доллары США, — ценные бумаги шести местных банков и финансовых организаций, а также акции 11 компаний. DeFi-сервисы биржи позволяют инвестировать в пулы ликвидности, стейкинг и фарминг. Капитализация к середине прошлого года составила 613.7 млн сомов ($1.2 млн). Председатель правления биржи и соучредитель Алмазбек Султанович держит самый крупный пакет акций в 42%.

BIAT — на рынке с 2023 года, зарегистрирована в Нидерландах, штаб-квартира в Бишкеке, есть филиалы в Объединенных Арабских Эмиратах. Поддерживает покупку, хранение и обмен BTC, ETH, USDT, USDC, XRP, DOGE, ADA, MATIC, DOT, TON, а также сомы, российские рубли, доллары США. Биржа не работает с резидентами ряда стран, включая Иран, США, Кубу, Беларусь. Biatex предлагает фиксированную торговую комиссию в размере 0.5%. Генеральный директор — Абдумалик Мухамедов. Партнеры: платежные сервисы Pay24, Quiq Pay.

Quantum — молодая биржа, получившая лицензию в 2024 году. Поддерживает 12 торговых пар: USDT, BTC, TRX, ETH, LTC, сомы, рубли, доллары. Возможны внебиржевые сделки от $20 000. Комиссия тейкера за мгновенное исполнение ордера — 0.25%, за размещение лимитного ордера вне рыночной цены — мейкер платит 0.025%. Комиссии и лимиты зависят от способа перевода: для банковских переводов в сомах комиссия на вывод — 50 сомов ($0.6) без максимального лимита, для вывода USDT (TRC-20) комиссия — 5 USDT, с лимитом до 1 млн USDT. Генеральный директор — Амасан Усупов.

Налогообложение обменников и бирж

Криптокомпании уплачивают корпоративный налог на прибыль от всей деятельности 10% и налог с продаж криптовалют 3%, который рассчитывается на основе разницы между ценой покупки и продажи актива.

Компании могут воспользоваться пониженной ставкой налога на прибыль — 5% на первые три года деятельности, а также могут быть освобождены от уплаты пошлины на прибыль и НДС на период до двух лет. Для этого они должны стать резидентами кыргызстанских «Парка высоких технологий» или «Парка креативных индустрий».

Использование криптовалют для внешней торговли

Иностранные финансовые организации боятся вторичных санкций — если выяснится, что обслуживаемые ими местные компании имеют связи с Россией. Местные экспортеры и импортеры используют обменники и биржи для ускорения возврата выручки и снижения затрат.

Соучредитель «ТокенСпот» Павел Нечаев поделился кейсом внешнеторговых операций: «Экспортер отправил товар из Кыргызстана, получил оплату в USDT, перевел на обменную площадку, а затем обменял на сомы, доллары или рубли. Средства можно вывести безналичным платежом и задекларировать банковскую операцию. В итоге бухгалтерия и налоговая служба получают все необходимые документы», — рассказал бизнесмен.

До 2022 года операции с криптовалютами в КР, включая обмен и переводы, находились в серой зоне. Принятие закона «О виртуальных активах» вывело рынок в легальное пространство, позволив снизить риски отмывания денег и финансирования терроризма.

Объем операций с криптовалютами в стране через обменные площадки с 2022 года составил около $4.2 млрд, основная доля приходится на USDT, чуть меньше на USDC и BUSD.

«В условиях западных санкций стейблкоины используются в международной торговле, для расчетов за автомобили из Китая и реэкспорт в Казахстан и Россию», — рассказала генеральный директор WeinCrypto DAO Елена Чигибаева.

Рост числа операций с цифровыми активами также объясняется притоком предпринимателей, в том числе примерно шести тысяч получивших гражданство и переехавших в Кыргызстан россиян, включая сооснователя криптобиржи Bitzlato Антона Шкуренко.

Особенности банковской системы Кыргызстана также способствуют популярности криптовалют. Корреспондентские отношения с зарубежными банками ограничены, усложняя проведение международных платежей. По словам Арстанбека Абдикапарова, в стране много число IT-компаний, оказывающих услуги в Европе, Великобритании и США:

«Западные банки часто видят риски при отправке платежей в Кыргызстан. Поэтому многие компании принимают платежи в криптовалюте, которую самостоятельно не могут обработать из-за отсутствия нужных компетенций. Мы помогаем, открывая счета, проверяя уровень риска кошельков и конвертируя крипту в фиатные средства», — объяснил бизнесмен.

Например, компании могут использовать платформы для выплаты зарплат сотрудникам в СНГ и Европе или для инвестиций.

Криптобанки Кыргызстана

Усовершенствование международной торговли с использованием криптовалют в Кыргызстане вылилось в разработку законопроекта о криптобанках, который в январе 2025 года Минэкономики представило парламенту.

Согласно законопроекту, криптобанки смогут выполнять операции и с фиатной валютой, и с цифровыми активами, включая покупку, хранение и переводы монет. Кроме того, функционал подобной компании предусматривает возможность операций с драгоценными металлами, деривативами, создание депозитариев ценных бумаг и тому подобное.

Создание криптобанков несет риски криптоиндустрии и государственной финансовой системе, уверяет Арстанбек Абдикапаров.

«Криптобанк, хотя и получает лицензию Нацбанка, фактически может конкурировать с ним, выпуская стейблкоины и ослабляя валютный контроль, создавая риски для монетарной политики и открывая возможности для обхода налогов», — сказал бизнесмен.

Криптобанки уязвимы к санкциям, в отличие от обменников, добавил Абдикапаров.

Традиционные коммерческие банки

Коммерческие банки Кыргызстана могут хранить, переводить и управлять виртуальными активами, а также оказывать услуги, связанные с первичным размещением и (или) продажей виртуальных активов. Однако их взаимодействие с крипторынком остается ограниченным.

«Для опытных пользователей финансовые институты как третья сторона в переводах криптоактивов не нужны. У банков пока нет технологий безопасного хранения криптовалют», — сказала Елена Чигибаева.

По ее словам, функционал банков соответствует требованиям к работе с цифровым сомом, запуск которого запланирован на 2027 год. Традиционные банки пока не реализовали ни одного совместного проекта с криптокомпаниями, например, для ввода и вывода средств на биржу или с биржи через карточку, отметила она.

Пять крупных банков и несколько операторов кошельков подали заявки в «песочницу» Нацбанка для работы с виртуальными активами, но детали обсуждений и участники держатся в секрете.

По словам руководителя WeinCrypto DAO, у коммерческих банков на первых порах возникают вопросы к безопасности операций, когда через банки на международные криптобиржи отправляются крупные суммы средств для покупки USDT. Потом, когда стейблкоины попадают на криптоаккаунт обменника или оператора виртуальных активов, возникают сложности с отслеживанием операций с активами.

«Банки, в первый раз столкнувшиеся с криптоактивами, не понимают, как фиксировать операции с криптовалютами, учитывать объемы активов и оформлять их для налогообложения», — сказала Елена Чигибаева.

Майнинг в Кыргызстане

Крупные игроки

В апреле 2024 году из 31 зарегистрированных в Кыргызстане майнеров фактически действовало только восемь компаний: «Ак-Буура», «Калининская ГЭС», «Кок-Сай», «Конур-Олон», «Сателлит 205», «Строительная фирма Анкай», «Тегермен», SolarCoin. Среди компаний есть как майнеры, так и дата-центры, предлагающие хостинг. Первые восемь компаний потребляют электроэнергию частных малых ГЭС, чья суммарная мощность составляет 25.1 млн КВт.

Крупнейший майнер SolarCoin с офисом в Бишкеке имеет дата-центр в Чуйской области. Руководитель компании — Айсана Исмаилова, учредители — Татьяна Мартынова, Люй Цзиньчэн и «НБТС КейДжи», принадлежащая крупной китайской интернет-компании The9.

Являясь вторым по величине потребителем электроэнергии в Кыргызстане, SolarCoin покупает электричество напрямую у госкомпании «Национальная электрическая сеть Кыргызстана» (НЭСК) по цене 5.04 сома (5.8 цента) за кВт. Это происходит вопреки запрету продавать государственное электричество майнерам, который был введен в 2019 году, заявили Bits.media участники крипторынка. Министр энергетики КР Таалайбек Ибраев утверждал, что SolarCoin получает электричество из России транзитом через Казахстан, от компании «Интер РАО».

С начала года крупнейший майнер потребил 39.2 млн кВт⋅ч. Китайская The9, в 2022 году получила в Кыргызстане лимит на 31.500 кВт электроэнергии, закупила электрооборудование и землю для майнинга.

Регулирование майнинга

С 2019 года майнинг в Кыргызстане столкнулся с ограничениями: компаниям запретили прямое подключение к центральной энергосети. Государственная «Национальная энергетическая холдинговая компания» ввела мораторий на выдачу технических условий из-за спада выработки на гидроэлектростанциях, обеспечивающих 90% энергии, что усугубило сложности на фоне роста числа энергопотребителей.

В 2020 году, с наплывом иностранных майнеров, привлеченных низкими тарифами и близостью к Китаю, потребление электроэнергии в Кыргызстане выросло до 15.5 млрд кВт⋅ч. Во избежание энергокризиса и для борьбы с «серыми майнерами» в стране легализовали добычу криптовалют и ввели тариф 2.24 сома (5.7 цента) за кВт⋅ч, налог 15% от стоимости потребленной электроэнергии, который в 2024 власти снизили до 10%.

«Таким образом, можно взимать налоги с майнеров, измеряя использованной электроэнергией, поскольку отследить, сколько на самом деле криптовалюты добыл майнер, технически невозможно», — объяснил соучредитель Royal Арстанбек Абдикапаров.

В 2023-м президент Кыргызстана Садыр Жапаров ввел на три года «режим чрезвычайной ситуации в энергетике» из-за снижения добычи ГЭС на реке Нарын и нехваткой генерирующих мощностей при стремительном росте потребления.

«Число пользователей энергосетей по-прежнему растет и в 2024 году достигло полутора миллионов, перегружая изношенную инфраструктуру. Несмотря на это, потенциал развития возобновляемых источников энергии, включая мини-ГЭС, ветряные станции и солнечные панели делают страну привлекательной для иностранных майнеров», — рассказала Елена Чигибаева.

По словам директора по развитию крупнейшего майнинг-пула в Восточной Европе Вячеслава Некрасова, гидроэнергетический потенциал Кыргызстана раскрыт всего на 1.5% и майнинг-индустрия может помочь через инвестиции в малые ГЭС.

«При создании майнинг-ферм рядом с ГЭС окупаемость проекта составит 3.5-5 лет вместо обычных десятилетий. Это особенно привлекательно с учетом мирового тренда на устойчивое развитие и возобновляемые источники энергии», — считает топ-менеджер.

В сентябре 2024 года в Кыргызстане получила лицензию на добычу криптовалют российская компания «МБТ Строй», разместившая аппаратуру стоимостью $20 млн внутри Камбар-Атинской ГЭС мощностью 30 МВт. В 2023 году строительство этого дата-центра одобрил президент Кыргызстана.

Что разрешено делать с криптовалютой в Кыргызстане

В Кыргызской Республике физические и юридические лица могут хранить, торговать, обменивать, майнить и выпускать криптовалюты согласно закону «О виртуальных активах» и постановлению правительства «О работе коммерческих банков с виртуальными активами КР».

Юрлицам в Кыргызстане разрешено выпускать и размещать цифровые активы в стране и за рубежом. Крипторынок регулируют Национальный банк Кыргызстана и Госфинадзор при Минэкономики Республики.

Виртуальные активы не считаются платежным средством, валютой или ценной бумагой, а используются для обмена или инвестиции. Они рассматриваются как собственность, что влечет за собой для физлиц налогообложение в размере 10% от прироста капитала на операции с криптовалютами.

Заключение

«Кыргызстану важно создать условия для блокчейн-стартапов и ориентироваться на опыт стран-первопроходцев в принятии криптовалют как резервной валюты, таких как Сальвадор, где криптовалюта интегрирована в экономику», — считает соучредитель WeinCrypto DAO Елена Чигибаева.

Гендиректор Royal Арстанбек Абдикапаров полагает, что из-за меняющегося в Европе криптозаконодательства требования к криптокомпаниям в ЕС значительно ужесточатся — и это приведет к релокации в юрисдикции с более мягким регулированием, такие как Кыргызстан.

«К нам уже обращаются партнеры из стран Балтии за помощью в получении лицензии и выстраивании бизнеса, желая сохранить клиентов. Мы прогнозируем увеличение числа криптокомпаний, переносящих свою деятельность из ЕС в Кыргызстан», — добавил бизнесмен.
