Как атака на Ethereum Foundation повлияет на одобрение ETH-ETF? Разбор от ForkLog

Ethereum Foundation и ряд других неназванных организаций получили запросы от SEC касательно статуса ETH. ForkLog разобрался, как это событие может повлиять на одобрение спотового биржевого фонда на базе второй по капитализации криптовалюты.

После регистрации BTC-ETF 10 января аналитики Bloomberg Эрик Балчунас и Джеймс Сейффарт оценили шансы на «зеленый свет» в 70% и 60% соответственно. Специалисты призвали ориентироваться на 23 мая — окончательный срок по предложению от VanEck.

Наличие уже зарегистрированного ETF на базе Ethereum-фьючерсов, присутствие в числе заявителей BlackRock помимо Grayscale, Franklin Templeton, VanEck, Fidelity и Invesco c Galaxy, а также отсутствие упоминания Ethereum в качестве ценных бумаг в исках SEC против Coinbase, Binance и Kraken делало подобные ожидания небезосновательными.

Подогреваемый также фактором Dencun эфир показал сравнимые с биткоином темпы роста, несмотря на активный спрос на биржевые продукты на базе цифрового золота.

После информации об «интересе» SEC к Ethereum Foundation ситуация, вероятно, развернулась на 180 градусов.

Еще раньше, ссылаясь на неактивный характер переговоров между эмитентами ETH-ETF и регулятором, эксперты Bloomberg снизили ожидания положительного вердикта до 35%. Теперь же они фактически признали, что на подобный исход в мае больше не стоит рассчитывать.

Согласно Fortune, текущие запросы к Ethereum Foundation и другим организациям связаны со стартовавшей еще в 2022 году кампанией регулятора по классификации ETH в качестве ценной бумаги.

Поводом стал The Merge — переход блокчейна второй по капитализации криптовалюты на алгоритм консенсуса Proof-of-Stake (PoS).

Еще в 2023 году глава SEC Гэри Генслер предупредил, что подобная модель может привести к трактовке токенов в качестве инвестиционных контрактов. Отсутствие конкретики в его ответах на наводящие вопросы касательно статуса ETH позволяло надеяться, что ведомство избежит «репрессий».

Вдобавок к «природе» PoS ведомство также заинтересовали документы и финансовые отчеты, связанные с бизнес-операциями Ethereum Foundation, что напомнило о развитии судебного процесса SEC против Ripple, завершившегося ничьей.

Основатель и CIO Ikigai Asset Management Трэвис Клинг назвал происходящее «скоординированной атакой» на ETH.

Их оппоненты рассчитывали, что частичная победа Ripple касательно статуса XRP и отсутствие трактовки CFTC второй по капитализации криптовалюты как ценной бумаги заставят SEC отступить.

Журналистка FOX Business Элеонор Терретт в январе предположила, что подобная определенность может возникнуть в ходе судебного разбирательства с Binance. Надежда была связана с заседанием, где было отмечено, что токены ДАО можно признать ценными бумагами. Теперь же она осознала причину низкой вовлеченности ведомства в процесс взаимодействия с эмитентами.

Джонссон отметил, что расследование также поможет Комиссии отклонить предложения на спотовый Ethereum ETF, избегая при этом «подрыва аргументов» в судебных исках против Coinbase и Binance.

В качестве третьей версии он назвал желание ведомства применить «мягкий подход», заявив о продолжающемся расследовании статуса ETH вместо использования правоприменительных мер.

Эксперт подчеркнул, что в качестве формальной причины для отказа SEC может указать не недостаточную корреляцию между фьючерсами и спотовыми рынками ETH.

Балчунас согласился, что показатель не столь убедителен, как было в случае биткоина. По мнению Джонссона, ситуация может носить временный характер, поскольку «уровни корреляции со временем улучшаются».

Риски потенциального манипулирования также упоминали специалисты BloFin и отраслевой юрист Джейк Червински. Неопределенность также привносит механизм PoS, в частности из-за положения о стейкинге в предложениях ряда эмитентов.

Глава цифровых продуктов Роберт Митчник не стал акцентировать внимание на ETH в последнем выступлении, что можно воспринимать как отсутствие больших ожиданий на май.

«Для наших клиентов биткоин в подавляющем большинстве случаев является приоритетом номер один. А затем немного Ethereum и совсем немного всего остального», — заявил топ-менеджер.

Остается только предполагать, как будут события развиваться дальше. Сможет ли с какого-то этапа SEC «услышать» аргументы сообщества и пойти на попятную? В результате ETH-ETF одобрят позднее — уже в 2025, согласно Сейффарту.

CIO Bitwise Мэтт Хоуган увидел в этом плюс, поскольку считает ориентир 23 мая «неидеальным». Свою позицию эксперт объяснил необходимостью подготовки к «перевариванию» инструментов на базе цифрового золота для переключения на альтернативы. Оптимальным был бы срок в восемь-девять месяцев после запуска BTC-ETF, добавил он.

При пессимистичном сценарии индустрии придется добиваться своего через суд. О такой перспективе, с которой «не хотелось бы вновь столкнуться», упоминала комиссарка ведомства Хестер Пирс. Еще в январе она выразила надежду, что продукт не потребует судебного процесса [Grayscale против агентства в отношении ETHE] для одобрения.

Остается еще вариант смены руководства SEC, что будет возможно по итогам выборов президента США в ноябре. Но это уже совсем другая история. Джонсон, к примеру, рассматривает целый ряд катализаторов.
